2. Memberships, Contract Terms, and Cancellation
- Membership Plans: Memberships are available in 6- and 12-month terms.
- Set-up Fees and Marketing Costs: Damages, disputes, or refunds will not exceed the amount paid for the membership less the $997 set-up fee, postage, marketing materials, and all advertising costs (including but not limited to costs for TV, streaming, social media, radio, or any promotion/distribution associated with the member’s listing or campaign).
- Cancellation: To be eligible for consideration of a refund, a written cancellation notice must be provided at least 30 days prior to the effective termination date of the membership. Failure to provide timely notice forfeits refund eligibility.
- Remedies: We reserve the right to address complaints or disputes by extending your membership term, or by offering additional incentives, including but not limited to pre-paid gift cards or items of value. Acceptance of any such incentive or extension constitutes full satisfaction and resolution of the dispute; no additional claims, rights, or entitlements will be honored thereafter.
3. Dispute Resolution
- Mediation: Any disputes, controversies, or claims arising from or related to your use of the Site or our services shall be resolved first and exclusively through mediation in Hillsborough County, Florida, before any legal action is taken. Both parties agree to share mediation costs equally.
- Arbitration: If mediation fails, disputes may be submitted to arbitration in accordance with Florida law.
4. Profiles and Directory Information
- Information Ownership & Use: LocalInsurancePros.com compiles information on public insurance adjusters from public sources. Adjusters may claim, modify, or request profile deletion via business email as listed in their state licensure database.
- Ownership of Created Materials: All commissioned, created, and published materials on this Site are owned by LocalInsurancePros.com unless otherwise specified in writing.
- Image and Likeness: By using this Site, you grant LocalInsurancePros.com permission to use your image, likeness, business profile, and related content for marketing and promotional activities as we see fit.
5. Limitation of Liability
- No Regulation or Endorsement: LocalInsurancePros.com is not a regulatory entity for public insurance adjusters. Formal complaints and licensure issues must be directed to the Florida Department of Financial Services (https://www.myfloridacfo.com/) or the relevant licensing authority in your state.
